Good afternoon Atty Bulao,
Just want to consult po – my mom will be applying for Schengen visa via French embassy and they require a copy of her birth certificate and marriage certificate. However, her name in both documents doesn’t bear a “Ma.” while her passport and baptismal certificate both bear a “Ma.” Negative finding kasi siya sa NSO though meron siyang birth certificate from the civil registrar.
Before, she had an affidavit of two disinterested persons attesting to her birth and the differences in name. Pero, it got lost somehow and we cannot find it now.
My question is do you think we can she just execute an affidavit of one & the same person for her passport, birth certificate & marriage certificate or should we execute the affidavit of two disinterested persons also?

DFA will produce your passport based on your BC. In case you will be asked to explain why your other records have DC middle initial, then you just execute an affidavit of discrepancy similar to the form that I provided. You would need the affidavit of discrepancy in case you are asked to explain the discrepancy in your names. Just compose one following the format i provided in my website and go to the nearest notary public for revision and when final, for notarization.

I think the defect in your birth certificate is typographical. I suggest you just go to the civil registry where your BC originated and ask them for assistance. They will give you a form which you will accomplish and have the same notarized. Please follow their further advice.

gay, two disinterested persons refer to two persons, not your relatives, who has personal knowledge of the facts you want to include/correct in your birth certificate.
i suggest you go to the civil registry of the place where you were born and get the form and advice.

i suggest from now on use the surname “ramos”, if possible. if you do not have a passport get one and they will issue you with the name appearing in your passport “ramos”. get driver’s license with the surname “ramos”. with these two government issued ids get bank account using the name “ramos”. with passport and driver’s license as your identity, execute an affidavit of discrepancy or affidavit of identity and always keep this with you. if asked why is it that in this or that document your surname is cunanan then present to them said affidavit as an explanation.

i presume your passport is in the name of veronica since passport is based on BC. your problem will arise if you are asked at the seminar to present your passport for identiy purposes. you therefore must execute an affidavit of discrepancy and be ready to present this in case you need to explain. this is the purpose of such affidavit. in some cases you might be asked to present an affidavit of two disinterested persons who has personal knowledge of you. execute also this document so that when needed or required you can present the same.

the dfa will based the passport on the name appearing in the birth certificate. if your father did not sign the acknowledgement portion then your passport will use the family name of your mother and you will have no initial.

how about getting a new passport. tell dfa you lost your passport. submit affidavit of loss. and submit your birth certificate. they will issue to you a new passport based on your birth certificate.

dfa will use the name appearing in the birth certificate. just keep ready the affidavit of one and the same person because you might need it when asked to explain why there is a discrepancy in the name appearing in your passport and that appearing in your other documents.

Good day po. Nais ko po sanang humingi ng advice regarding my school records. Since elementary school years ko po kasi mali yung nagamit ko na year of birth. Dapat po ay 1981, sa school records ko po ay 1982. During my college years, dahil wala kami mahanap na birth certificate, nagpagawa po ang mother ko ng late registration. In that document, 1982 ang year of birth kaya lang mali yung spelling ng surname (maiden name) ng mother ko. So using that document, nagsubmit ako ng personal affidavit at joint affidavit of two disinterested persons sa aking school upang isunod ang middle name ko sa maling spelling ng surname ng mother ko sa late registration birth certificate. Kaya nanatiling 1982 na yung birth year ko at sinunod ko yung maling spelling na surname ng mother ko sa aking school records. After 5 years of working, nakakuha ako ng certificate of live birth dito sa NSO Manila kung saan lumilitaw na 1981 talaga ako ipinanganak at doon tama ang spelling ng apelyido ng mother ko. Naipa-correct ko na po ang PRC, SSS, TIN, at Philhealth records ko alinsunod sa nakuha kong NSO birth certificate. Ang problema ko po ngayon ay ang aking school records. Pwede ko po ba ipawalang bisa yung sinumbit ko dati na personal affidavit at joint affidavit of two disinterested persons on the basis of my NSO certificate of live birth? Ano po ang dapat kong gawin?

I suggest you visit your local civil registrar and ask advice. As I see it the difference is not only typographical. You might need to go to court to have it changed. But please see the nearest local civil registrar and ask advice.

Im now preparing all my US Visa petition papers however upon checking my aunt’s Birth Certificate through NSO there was a discrepancy in her Birth date against her passport and all US records. (NSO record shows October 30, 1959 but it should be Oct. 31, 1959). Do you know or suggest any legitimate and accredited agency here in Manila that can issue an Affidavit of Discrepancy for Date of Birth that can suffice the requirement of the US Embassy? I suggest you see the US Embassy on this. They are the ones who will approve. If they say an affidavit of discrepancy is sufficient then you have no problem. Any lawyer can preprare that document but it must be notarized by a notary public accredited by the US Embassy.

Affidavit of Correction lang po yan. Go to the nearest civil registrar and get a form for that purpose. They will advise you how to fill up that form and the subsequent procedure and where to file.

Alfredo, kung jose alfredo sa birth nyo, hindi nyo na po mapalitan nyan. Kung ang gamit ninyo mula noon ay alfredo lang then continue using it. In case you are asked to explain why, then you submit an affidavit of discrepancy showing that jose alfredo danieles at alfredo danieles refer to one and the same person. Pag nag apply kayo ng passport and jose alfredo ang ilagay ng dfa sa passport ninyo kasi depende sila sa kung anong nakasulat sa birth certificate ninyo. palagi lang kayong may affidavit of discrepancy na dala.

I think an affidavit of discrepancy will suffice unless they tell you that you have to submit a Joint Affidavit of Two Disinterested Persons. Why bother two disinterested persons if the affidavit of discrepancy in name due to typographical error would suffice.

Jenny, i suggest you go to the office of the civil registry and ask the procedure for effecting correction of entry in the birth cirtificate. It appears that the error is only typographical. It can be corrected administratively.

carren, if the father signed the back page acknowledging that the child is his, the child can use the family name of the father and therefore magkaroon siya ng middle name which is the surname of the mother.

I suppose this concerns and erroneous entry in your birth certificate. Ask PRC if affidavit of discrepancy is OK with them. If ok you may try to draft one based on the model i provided in my website. Send it to me and I will finalize it.

The name appearing in your passport will be the name that will be written in your passport. What you should do is to go to NSO or to the civil registry to have your name corrected in your birth certificate. An affidavit of discrepancy will not solve the problem.

The error may not be only typographical. In such a case a petition for correction in of entry in the birth cirtificate is necessary. Contact a lawyer friend, if you have one.

You have to file in court a petition to correct entry in birth certificate. Find a lawyer near your place, preferably one who has an experience in filing such petition.

Will securing an affidavit of discrepancy an option for me to have a passport,or do you have any suggestions .I went to my local registrar in Pampanga but they were asking for a lot of documents from me and from my father since Im Jr to Edwardo Sr. which I cannot provide, and they told me that it will take a while to process it. I need to have a passport in no time, please help.I would really appreciate if you could send me an email to the address stated below,Thank you.

gud am. ask ko lang po sana gusto mag apply ng mother ko ng passport sa dfa kaso ang lahat ng valid id nya ay surname ng father ko kaso hindi sila kasal , my mother is already a senior citizen age 80yrs old ,sabi ng dfa gumawa lang ng affidavit of discrepancy , ok lang po ba yun ?

Good Day Atty.Jose Angelito B.Bulao. Ako po si Victor Silor Rosales from Iligan City. gusto ko lng po humingi ng payo nyo about sa middle name ko na ginagamit sa lahat ng mga papers ko, licenses and others. Ang SILOR na middle name ginagamit ko ay hindi magkatugma sa NSO BC which is SELOR.
Gusto ko kasing magapply ng passport ds month,.Pwede ba tanngapin sa DFA ang AFFIDAVIT of DISCREPANCY sa middle name ko?

Please go to the Office of the Civil Registry where your birth certificate was first filed. They have a form to effect such correction since the discrepancy is just typographical. They will advise you what to do.

Atty.Jose Angelito B.Bulao gud day po,ngpagawa po ako ng Name of Discrepancy pra po makakuha ng passpot sa kadahilanang sa birth certificate ko po ay MARIBETH at yung sa kasal po nmn ng asawa ko ay MARIBEL nai suggest po ito ng mga kasama ng asawa ko dahil ganon dn po ang gnawa nila kya nakuha nila ang pamilya nila papunta Australia,pero nung pumunta po ako ng DFA nagtanong po ako sa Costumer Service nila hndi dw po valid ang pinagawa ko,nagta2ka lng po ako kc 2009 yan dn po ang gnawa ng mga kasama ng asawa ko sa trabaho at lahat po cla ay nandon na,pra saan lng po ba tlaga dapat gamitin ang Name of Discrepancy

una, yung name nyo sa passport ay Maribeth because it is the name appearing in the birth certificate? If so, the descripancy in the name appearing in the marriage certificate and that in the passport and birth certificate can be explained by an affidavit of descripancy. perhaps, they are questionning the contents of the affidavit of descripancy. please scan and email to me and i will email back.
